10. EXPANSION OF MEMBERSHIP. Participation in TVDEC shall be limited to the members who are parties to the Interlocal Cooperation Act Agreement; provided, however, the members may expand the membership of TVDEC by the unanimous consent of all of its members. The TVDEC Governing Board shall receive and consider applications from educational institutions who request participation in TVDEC’s distance-learning system. The TVDEC Governing Board shall act upon such requests and, if such request is granted, shall establish the fees, costs, charges, leases, assessments, and other conditions required for participation by the applicant in the TVDEC distance-learning system.

The proposed section/paragraph/sentence would read as follows:

The TVDEC Governing Board shall receive and consider applications from educational institutions who request participation in TVDEC’s distance-learning system. The TVDEC Governing Board shall act upon such requests and, if such request is granted, shall establish the fees, costs, charges, leases, assessments, and other conditions required for participation by the applicant in the TVDEC distance-learning system.

Rationale for the proposed change:
As the Governoring Board of the Tri-Valley Distance Education Consortium officially meets only once a year and that approval of expansion of membership would require approval from all members, it is difficult to get a timely vote from all members concerning expansion.
In reviewing other Nebraska Consortium bylaws, the Niobrara Valley Tele-Partnership Consortium has a three-fourths (75%) consent and Southwest Nebraska Distance Learning Consortium has a two-thirds (67%) consent of its members when voting on expansion of membership.


(The Governoring Board unanimously voted at the August 1, 2002 meeting to amend the interlocal agreement as stated in the above bylaw proposal.
